Доброго дня, шановні колеги Interlegal!
Прошу взяти на врегулювання demurrage по т/х MV Demo, рейс Constanta → Algeciras (червень 2024). Charterer Cargill Black Sea заперечує валідність NOR (на наш погляд — безпідставно), і вже четвертий місяць тягне з оплатою $13,547.
Charter Party — Gencon 1994 від 22.03.2024, English law, LMAA. Time bar — 90 днів від completion of discharge (2024-06-08), тобто до 2024-09-06. Залишилось ~24 дні.
Також додаю переписку з charterer'ом за останні два місяці — там вони вперше згадали, що NOR начебто був tendered "до того, як судно стало в free pratique". Це неправда, але хочеться почути вашу позицію.

Please take up our demurrage claim on MV Demo, voyage Constanta → Algeciras (June 2024). Charterer Cargill Black Sea disputes NOR validity (we think unjustifiably) and has been holding out for four months on the $13,547.
Charter Party — Gencon 1994 dated 22.03.2024, English law, LMAA. Time bar — 90 days from completion of discharge (2024-06-08), so until 2024-09-06. ~24 days remaining.
I also attach correspondence with the charterer from the last two months — they argued for the first time that NOR was "tendered before vessel was in free pratique". This is incorrect, but we want your position.

Demurrage claim: USD 13,547.00
Dear Sirs,
We act for Bulker Lines Ltd, the owners of the vessel MV Demo (the "Vessel"), in respect of the voyage performed under the above charterparty (the "CP"). This claim is presented within the 90-day time bar specified in clause 6(g) of the CP, completion of discharge having occurred at 02:15 LT on 8 June 2024.
1. The Voyage
The Vessel loaded 25,000 MT of wheat in bulk at Constanta and discharged at Algeciras. Notice of Readiness was duly tendered at Algeciras on 3 June 2024 at 08:00 LT and accepted at 12:00 LT, after free pratique had been granted at 08:42 LT.
2. Laytime
Pursuant to clause 6 of the CP, laytime allowed for discharge was 84 hours SHINC. The attached laytime statement (Schedule 1, generated by our deterministic calculation engine, version 0.1.0-alpha) shows laytime used of 122.25 hours, calculated from NOR acceptance at 12:00 LT on 3 June 2024 to completion of discharge at 02:15 LT on 8 June 2024, with no permissible deduction under the CP terms.
The difference of 38.25 hours is therefore on demurrage.
3. Demurrage
At the contractual rate of USD 8,500 per day pro rata (clause 7), 38.25 hours equals USD 13,546.88, rounded to USD 13,547.00.
We note your earlier suggestion that NOR may have been tendered before the Vessel was "in free pratique". With respect, this contention does not arise on the facts: the SOF records WIBON status as of 08:00 LT and free pratique granted at 08:42 LT, both predating NOR acceptance at 12:00 LT. The CP terms WIBON/WIFPON at clause 6(c) are accordingly satisfied. See [VERIFY: The Mass Glory [2002] 2 Lloyd's Rep 244 — confirm cite via i-law].
4. Demand
We hereby formally demand payment of USD 13,547.00 within 14 days from the date of this letter, by wire transfer to the account specified in the attached owner's invoice. Failing payment, we reserve our client's rights to commence LMAA arbitration proceedings without further notice.
5. Reservation of Rights
This letter is sent without prejudice to all of our client's rights and remedies, all of which are expressly reserved.

Dear Sirs,
We have considered your demurrage demand of USD 13,547 carefully. The claim is rejected in full, alternatively in the amount claimed, for the reasons set out below.
1. Validity of NOR
Although NOR was tendered at 08:00 LT on 3 June 2024, our position is that the Vessel was not, at that time, in compliance with the WIFPON condition under clause 6(c). The granting of free pratique at 08:42 LT does not retrospectively validate a NOR that was invalid when tendered. See [VERIFY: The Northgate [2008] 2 Lloyd's Rep 511 — confirm cite via i-law].
On that basis, time should not begin to run until 12:00 LT on 3 June 2024 at the earliest, which yields a laytime used of 118.25 hours, not 122.25 hours, and reduces the demurrage to USD 12,128.
2. Deduction for shifting
The SOF records two anchorage shifts (4 June 14:30-16:00 and 5 June 06:00-07:30), totalling 3 hours, which fall to be deducted under clause 8 of the CP (shifting time for charterer's account on first shift only). Net adjusted demurrage: USD 11,062.
3. Without-prejudice settlement offer
Without prejudice to the above, our client is prepared to settle the entire claim at USD 9,500, in full and final settlement, payable within 30 days against signed release. This offer is open for 14 days and is withdrawn thereafter without further notice.
